abstract This paper begins by accepting, for argument's sake, a number of the central criticisms raised regarding the US led war in Iraq. In the remainder of the paper, it is argued that even if these criticisms are assumed to be true, the resort to war was still morally justified, both prospectively and retrospectively. The argument is made within the context of the just war tradition. It is argued that the resort to war met the conditions of sufficient just cause, (...) last resort and proportionality, and that any failings in regards to legitimate authority and right intention do not undermine the morality of that resort. More specifically, the case is made that: humanitarian considerations provided a sufficient just cause, questions of international law do not undermine the moral legitimacy of the US led coalition, and that concerns about the intentions of the US, even if valid, would not impact on moral judgements about the act of resorting to war. In arguing for the last point, it is determined that the right intention condition should not be included among the set of conditions that form the basis of the just war tradition. (shrink)

In growing recognition that the business community must play a key role in the global issues encapsulated by the United Nations Sustainable Development Goals, Babson College, which has a business-focused curriculum, has striven first to reinvent its teaching of ethics and then, particularly over the past decade, to enhance its focus on sustainability, social responsibility, and social entrepreneurship. As previous initiatives did not build sufficient linkages between the liberal arts, natural sciences, and business curriculum, the College is now engaged in (...) a far more comprehensive effort to educate our undergraduate business students in “integrated sustainability,” which it defines as “systems thinking that integrates ecological integrity, social responsibility, and value creation simultaneously.” By examining the meaning, skills, and pedagogical opportunities in systems thinking within the context of larger discussions on humanistic management, this article shows how systems thinking is a particularly fruitful way to ground business students in the natural sciences and the liberal arts, develop their complex problem-solving skills, and thereby reinvigorate management education in ways that prepares students to “render service to humanity.” Our hope is that sharing Babson College’s experience in this regard – both our successes and challenges - may provide useful insights to other faculty and academic leaders seeking to enhance humanistic management within their own higher education institutions. This paper applies models of the onset of adolescent sexual intercourse using national data from Denmark and the USA. The model gave excellent fits to data on Danish Whites and a good fit to American Whites, but the model-fits for American Blacks and Hispanics were not as good. The weakness of the latter model fits may reflect either real processes that the model does not capture or problems in the reliability of adolescent sexuality data.

There is a global shortage of organs for transplantation and despite many governments making significant changes to their organ donation systems, there are not enough kidneys available to meet the demand. This has led scientists and clinicians to explore alternative means of meeting this organ shortfall. One of the alternatives to human organ transplantation is xenotransplantation, which is the transplantation of organs, tissues, or cells between different species. The resurgence of interest in xenotransplantation and recent scientific breakthroughs suggest that genetically-engineered (...) pigs may soon present a realistic alternative as sources of kidneys for clinical transplantation. It is therefore important for nurses and allied health professionals to understand what is involved in xenotransplantation and its future implications for their clinical practices. First, we explore the insufficiency of different organ donation systems to meet the kidney shortage. Second, we provide a background and a summary of the progress made so far in xenotransplantation research. Third, we discuss some of the scientific, technological, ethical, and economic issues associated with xenotransplantation. Finally, we summarise the literature on the attitudes of healthcare professionals toward xenotransplantation. (shrink)

Formal clinical trials of pig-to-human organ transplant—known as xenotransplantation—may begin this decade, with the first trials likely to consist of either adult renal transplants or pediatric cardiac transplant patients. Xenotransplantation as a systematic scientific study only reaches back to the latter half of the 20th century, with episodic xenotransplantation events occurring prior to that. As the science of xenotransplantation has progressed in the 20th and 21st centuries, the public's knowledge of the potential therapy has also increased. With this, there have (...) been shifting ethical stances toward xenotransplantation in key areas, such as religious and public viewpoints towards xenotransplantation, animal rights, and public health concerns. Rodger et al 1 argue that ‘ethically defensible xenotransplantation should entail the use of genetic disenhancement if it is demonstrated that’ the pain and suffering of donor pigs ‘cannot be eliminated by other means’. The phrase ‘genetic disenhancement’ refers to genetic manipulation that would produce an animal that is either less able or entirely unable to experience pain and suffering. (The phrase is euphemistic because, on one possible reading, it suggests the removal of an existing enhancement, rather than what (...) it actually is, namely a diminishment relative to the species norm.) The authors acknowledge that genetic ‘disenhancement’ is not a ‘morally ideal ‘solution’, but argue that ‘it is morally better to prevent unavoidable pain until a viable non-animal alternative becomes available’ (p. 1). In advancing this argument, they explicitly state that they make no assumption that xenotransplantation is, in principle, morally permissible. They take no stand on that issue, which is beyond the scope of their paper. They assume only that ‘ (1) xenotransplantation research will inevitably continue and (2) causing pain and suffering requires sufficient justification’ (p. 1). In ’Abortion and deprivation: a reply to Marquis’, Anna Christensen contends that Don Marquis’ influential ’future like ours’ argument for the immorality of abortion faces a significant challenge from the Epicurean claim that human beings cannot be harmed by their death. If deprivation requires a subject, then abortion cannot deprive a fetus of a future of value, as no individual exists to be deprived once death has occurred. However, the Epicurean account also implies that the wrongness of murder is also (...) not grounded in the badness of death, which is strongly counterintuitive. There is an alternative: we can save our intuitions by adopting a more moderate Epicurean account such as that proposed by David Hershenov, who grounds the wrongness of killing in the prevention of the benefit of further good life rather than in the badness of death. Hershenov’s account, however, is equally applicable to Marquis’ argument: abortion similarly prevents a fetus from enjoying the benefit of a future like ours. Consequently, we conclude that Christensen’s criticism of Marquis’ argument fails to undermine his reasoning. (shrink)

Rodger et al have interestingly argued that xenotransplantation should, if possible, entail the use of genetic pain disenhancement to prevent otherwise unavoidable pain in ‘donor’ animals.1 Their argument relies on the empirical assumption that xenotransplantation offers a realistic solution to organ shortage, and that, due to the recent clinical developments and the lack of human donors, it will thus continue for the foreseeable future. We argue below that other options should be prioritised over xenotransplantation, and that so-called ‘non-sentientist’ harms (...) are undervalued in discussions on disenhancement. We do not challenge the empirical claim made by the authors. That is, xenotransplantation research might continue for the foreseeable future since organ demand is increasing. However, we disagree with the priority given to xenotransplantation over other solutions that are more morally desirable. We argue that, if we comply with the 3R principles (Replacement, Reduction, and Refinement of the use of animals in research) and follow a minimal welfarist reasoning (to which the authors seem to adhere), then (1) the principle of replacement demands the use of non-animal alternatives if possible and (2) there are alternative solutions that lead to morally better consequences. Anna Smajdor and Joona Räsänen argue that we have good reason to classify pregnancy as a disease. They discuss five accounts of disease and argue that each account either implies that pregnancy is a disease or, if it does not, it faces problems. This strategy allows Smajdor and Räsänen to avoid articulating their own account of disease. Consequently, they cannot establish that pregnancy is a disease, only that plausible accounts of disease suggest this. Some readers will dismiss Smajdor and Räsänen’s (...) claims as counterintuitive. By analogy, if a mathematical proof concludes ‘2+2=5’, readers will know—without investigation—that an error occurred. Rather than dismiss Smajdor and Räsänen’s work, however, the easiest way to undermine their argument is to describe at least one plausible account of disease that (i) excludes pregnancy and (ii) avoids the problems they raise for it. This is our strategy. We focus on dysfunction accounts of disease. After outlining Smajdor and Räsänen’s main arguments against dysfunction accounts, we explain why pregnancy is not a disease on these accounts. Next, we defend dysfunction accounts against the three problems that Smajdor and Räsänen raise. If successful, then contra Smajdor and Räsänen, at least one plausible account of disease does not imply that pregnancy is a disease. We suspect that defenders of other accounts can respond similarly. Yet, we note that insofar as dysfunction accounts align with the commonsense intuition that pregnancy is not a disease, this, all else being equal, seems like a point in their favour. (shrink)

Contrary to what many philosophers believe, Calvinism neither makes the problem of evil worse nor is it obviously refuted by the presence of evil and suffering in our world. Or so most of the authors in this book claim. While Calvinism has enjoyed a resurgence in recent years amongst theologians and laypersons, many philosophers have yet to follow suit. The reason seems fairly clear: Calvinism, many think, cannot handle the problem of evil with the same kind of plausibility as other (...) more popular views of the nature of God and the nature of God's relationship with His creation. In order to achieve this demonstration, the author resorts to a different methodology as opposed to a Kantian a priori argument. A dialectic articulation is built so that the epistemology of Michel Henry and the phenomenology of biology of Hans Jonas may be critically revisited. Such work is made in the light of the Aristotelian theory of hylemorphism, which is restored within a Darwinian framework by Dominique Lambert in his philosophical works. When it is combined with Henry and Jonas’s insights, a contemporary renewal of the “theory of the forms” sheds light on the reasons why behaviors of care toward vulnerable persons in human societies are so important. Deeply original, inspiring to some, abhorrent to others, George Berkeley’s philosophy of immaterialism is still influential three hundred years after the publication of his most widely read book, _Three Dialogues Between Hylas and Philonous. _Berkeley published the _Dialogues _because of the unenthusiastic reception of his _Principles of Human Knowledge _in 1710._ _He hoped the use of the_ _dialogue format would win a more favorable hearing, but unfortunately for Berkeley, the response was every bit as scathing as the reception of his (...) previous work. In recent decades, Berkeley’s work has been recognized as an excellent introduction to the English philosophy of the eighteenth century, and to philosophy in general. _The Gift of Death_, Jacques Derrida’s most sustained consideration of religion, explores questions first introduced in his book _Given Time_ about the limits of the rational and responsible that one reaches in granting or accepting death, whether by sacrifice, murder, execution, or suicide. Derrida analyzes Czech philosopher Jan Patocka’s _Heretical Essays in the Philosophy of History _and develops and compares his ideas to the works of Heidegger, Lévinas, and Kierkegaard. Inferential Internalists accept the Principle of Inferential Justification (PIJ), according to which one has justification for believing P on the basis of E only if one has justification for believing that E makes probable P. Richard Fumerton has defended PIJ by appeal to examples, and recently Adam Leite has argued that this principle is supported by considerations regarding the nature of responsible belief. In this paper, I defend a form of externalism against both arguments. This form of externalism recognizes what (...) I call the phenomenon of reflective defeat: if one is justified in not believing that E makes probable P, then this defeats whatever justification one has for believing P upon the basis of E. I argue that this modified version of externalism has the virtue of accommodating the intuitions that motivate internalism, without the cost of the vicious regress that makes internalism so unattractive. The public forum has been connected to the functioning of democracy, expressive freedom, and the media's role in society. While the public forum's legal contours have been examined, the ethical foundation of the public forum has not. Relying on archival research, this article argues that ideas about the public forum can be traced to the pragmatism of Grenville Clark, who influenced ideas about the public forum through his work on the American Bar Association's Bill of Rights Committee.

Literary scholarship has paid little serious attention to Habermas' philosophy, and, on the other hand, the reception of Habermas has given little attention to the role that literary practice can play in a broader theory of communicative action. David Colclasure's argument sets out to demonstrate that a specific, literary form of rationality inheres in literary practice and the public reception of literary works which provides a unique contribution to the political public sphere.

This chapter argues that ethics plays an extremely important role in decision making and lawmaking in bioethics issues. These decisions are not simple case-by-case judgments; rather, they rest upon deeply considered ethical opinions. It also discusses the implications of this epistemic grounding for bioethics and its use of case law materials as an ethical resource. Finally, since many people base their moral judgments on religious beliefs, the religious implications of this legal-moral relationship are considered.

Its publication in 2021 coincided with the fiftieth anniversary of the first publication of David Ireland’s The Unknown Industrial Prisoner (...) (1971). This experimental novel, centered on a “kaleidoscopic vision” of its characters and their lives, tells the story of a group of workers at the Puroil refinery in a fictionalized part of Sydney. In Heino’s own words, this project emerged from a desire to write about industrialization and representation in Australian fiction. Working primarily as a legal scholar and historian, this work represents his first foray into literary geography.At the heart of Heino’s argument is a question: What does literature know about space? In his pursuit of a spatially-directed reading of The Unknown Industrial Prisoner, Heino eschews work in literary geography that cultural geographers might recognize— particularly the writings of Sheila Hones, the doyenne of an emerging interdiscipline of literary geography, whose practitioners work at the interstices between literary studies and geography. Heino criticizes this interdisciplinary literary geography as being too focused on establishing the “sovereignty” or “imperialism” of fictional space at the expense of recognizing the [End Page 132] role of literature in the world. Arguably, such a stance is a misreading of the thinking within literary geography that “reading literature is essentially an experimental process in which the categorical distinction between the frames of ‘fact’ and ‘fiction’ become blurred,”1 and where the “ontological distinction between literary and non- literary spaces” is undermined.2 Neither of these statements supposes that reading literature is a practice by which the world falls away and nothing remains but the book. Instead, following Doreen Massey’s idea that space is a complicated process of events and happenings, literary geographers in this mold argue that fiction is a part of life as it happens, and reading is a constitutive practice in the co- production of space.In its place, Heino emphasizes a form of literary geographical thinking that understands literature’s role as being separate from, but intimately connected to, the actual world. His theoretical framework is multi-layered, borrowing from Marxist literary scholars, including Terry Eagleton and Fredric Jameson, and Marxist geographers, including Henri Lefebvre. In essence, however, it can be expressed neatly in the following quotation from geocritic Bertrand Westphal:Fiction does not reproduce the real, but actualises new virtualities that had remained unformulated, and then goes on to interact with the real according to the hypertextual logic of interfaces... fiction detects possibilities buried in the folds of the real, knowing that these folds have not been temporised.3I think that Heino’s rejection of what he characterizes as poststructural literary geography, of the kind represented in his analysis of Sheila Hones’s work, misses some opportunities. First, there are similarities between his conception of literary geography and those he leaves aside— not least, their shared acceptance of the productive tension that sits between literature as text and world as practical, non- representational, and exceeding narrative. Secondly, the shared aim of both approaches is to understand how “representation ‘takes place’ and precisely how texts are part of what happens.”4 This is particularly powerful in the light of Heino’s aim to understand the development and contents of literary texts in materialist terms. Despite these areas [End Page 133] of convergence, Heino’s argument that literary geography’s potential to analyze class and political structures remains untapped is well founded. This is where Heino’s contribution is at its strongest.Heino’s work is at its most convincing when he discusses the realities of “abstract space” that both permeate the spaces of The Unknown Industrial Prisoner and structure the very fabric of latter- twentieth century Australia. Running through both Heino’s critique and Ireland’s novel is an understanding “that the inherent drive of capital is towards the creation of a fragmented, homogenised and hierarchised space within which it can produce and...
